Payment is due at time of service and may be made by cash, check or credit card. As of 8-1-2024. All Payments made by credit card will incur a convenience fee of 3.5% for Visa, Master Card, Discover and American Express. Per NJ law this fee is part of a service and therefore subject to NJ Sales tax.
CANCELLATION POLICY:
Unless other agreements have been made, customers may cancel a tank pump out, portable unit rental or repair work with no cancellation fee at least 24 hours prior to any work completed by calling 609-758-2700 and verbally cancelling appointments with a staff member.
Within 24 hours of appointment but prior to the service truck being en route to the job location a $50 cancellation fee may be charged. If a truck is en route or has arrived at the job location and services/rental is cancelled or refused a fee equal to 50% of the quoted work to have been completed will be charged as a cancellation fee.
Customer agrees to provide suitable roadways or approaches to points of delivery when truck must go off of any paved surface. If such suitable roadway’s or approaches are not provided Don E Miller Septic Service, Inc. & Donny’s Potty’s (to be further known as “Company”) reserves the right to refuse all services, deliveries and/or pick up’s until the conditions are remedied. In the event that customer orders services, delivery or pick up beyond the curb lines, Company will not assume liability nor will it be held liable for damage to sidewalks, driveways, or other property and Customer hereby agrees to indemnify and hold Company harmless against all liability, loss and expense incurred as a result of such delivery/pick up
GENERAL TERMS & CONDITIONS:
The Customer further agrees to protect, indemnify and save Company harmlessagainst any and all claims, demands, and causes of action on account of bodilyinjuries to or death of any person or persons, or damage to any property or project, including loss of use thereof, arising out of or resulting directly or indirectly from the work to be performed by the Company, unless such injury or damage be caused by the sole negligence of Company; the Customer shall bear any expense, including counsel fees, which Company may incur by reason of any such claims or demands, whether real or alleged, and the Customer, if requested, shall assume and defend, at his own expense any such suits. The Customer’s obligation under this section shall not be limited in any way by any limitation on the amount of type of damages, compensation or benefits payable by or for the Customer under worker or workmen’s compensation acts, disability benefits acts or other employee benefit acts
Customer agrees that any and all costs for repairs or towing of Company's trucks and/or equipment resulting from the Customer’s method or location of loading/unloading or from any other cause while loading/unloading, or due to the Customer’s negligence while on site of the work, shall be borne by the Customers. It is further agreed that if conditions are not corrected and damage is continued, the Company reserves the right to discontinue deliveries until the cause for the damages has been eliminated.
DISCLAIMER:
Companyprovides no warranty, express or implied, including any warranty of merchantability or fitness for purpose, or any other warranty whatsoever, that the system meets any code or specifications or will function properly for any period of time whatsoever, or otherwise will not malfunction or cause contamination of the ground or waters of the state, county, parish or jurisdiction. All material is guaranteed to be as specified. All work to be completed in a workmanlike manner according to standard practices. Any alteration or deviation from above specifications involving extra costs can be executed upon verbal or written orders, and will become an extra charge over and above the estimate. All are agreements contingent upon strikes, accidents or delays beyond our control. Customer is to carry fire, tornado, and other necessary insurance.
Our workers are fully covered by Workman’s Compensation Insurance. Customer assumes all responsibilities and/or costs for any damage caused to any aboveground or underground utilities (such as electrical, phone, cable, gas lines, etc.) and/or any fences, sidewalks, curbs, driveways, sprinklers or landscaping on property while work is being completed. Company is not responsible for
the settling of soil or for ponding of ground water on Customers property. Customer is responsible for completing all maintenance to the septic system and all its components. Any work performed shall not and will not constitute, and shall not be construed by the customer, as a warranty by Company that a septic system will function properly for any period of time or for any particular loading or usage.
